KalyKala — Terms of Use

These Terms of Use (“Terms”) govern your access to and use of KalyKala, an online service published at kalykala.com providing a directory and guide covering the island of Kalymnos, Greece (the “Service”). The Service also includes companion tools we publish on subdomains of kalykala.com, except where a companion service publishes terms of its own: the KalyKala Climbers mobile app, KalyKala Found (found.kalykala.com), and Shadeline (shadeline.kalykala.com) each have their own terms, which govern them instead.
The Service is operated by KalyKala LLC(“KalyKala”, “we”, “us”, or “our”), a limited liability company organised under the laws of the State of New Mexico, United States, with its address at 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, United States.
The Service is provided entirely online and is available in many countries. It is not offered as a local service in any particular country, and we make no representation that the Service or its content is appropriate or available for use in any given location. You are responsible for complying with the laws that apply to you where you access it.
By using the Service — browsing it, signing in, listing a business, joining or posting an activity, sending feedback, or scanning a KalyKala QR code — you agree to these Terms. If you do not agree, please do not use the Service.
1. Acceptance of these Terms
By accessing or using the Service in any way, you accept these Terms and agree to be bound by them. If you use the Service on behalf of a business (for example, by claiming or editing a business listing), you confirm that you are authorised to act for that business, and “you” in these Terms means both you and that business.
These Terms apply together with our Privacy Policy, which explains what limited data we hold and how it is handled.
2. What KalyKala Is — and Is Not
KalyKala is a directory and guide for Kalymnos: it lists places, activities, ferry information, tips, and links, and helps people find and reach them.
- It is a directory, not a marketplace. KalyKala is not a booking platform, a payment platform, a travel agency, a tour operator, a broker, or an agent for any business, host, or user. We provide the listings, the pages, and the tools; we do not run the businesses, host the activities, or take part in what happens between users and the people or businesses they find through the Service.
- Charges. Access to the Service is currently provided at no charge. We reserve the right to introduce paid, premium, promoted, or sponsored features at any time, and to change what is offered at no charge. Any charge will be made clear before you incur it, and nothing in these Terms obliges us to keep any part of the Service free.
- Commercial arrangements. We may earn commissions on affiliate or referral links (for example, links to ferry booking), and we may accept payment for promoted or sponsored placements. Where a placement is paid for, we will identify it as such. Commercial arrangements do not change the disclaimers in section 9 or the liability limits in section 10, and they do not make us a party to any transaction between you and a third party.
- We do not sell your personal data, and we do not profile you for advertising. See the Privacy Policy.
2A. Availability and Changes to the Service
We may add, change, suspend, restrict, or discontinue the Service or any part of it — including any listing, feature, or piece of content — at any time and without notice or liability. We do not guarantee that the Service, or any particular listing or feature, will remain available.
3. Who Can Use the Service, and Accounts
Anyone may read the public parts of the Service without an account.
Some features — claiming or editing a business listing, submitting a business for listing, and joining, posting, or commenting on activities — require you to sign in. Sign-in is provided through Clerk using Google sign-in only.You are responsible for keeping your account secure and for activity carried out under it. Your use of Google sign-in is also subject to Google’s own terms.
The Service is not directed at children. To sign in and use the interactive features, you must be old enough to hold a Google account and to enter into a binding agreement under the law that applies to you.
4. Acceptable Use
When you use the Service, you agree that you will not:
- Use the Service for any unlawful purpose, or in any way that breaks applicable law.
- Post or submit content that is false, misleading, or impersonating, or claim or edit a business listing that you are not authorised to represent.
- Post or submit content that is unlawful, harmful, hateful, harassing, threatening, defamatory, obscene, or that infringes anyone’s intellectual-property, privacy, or other rights.
- Use the activities, comment, coordination, or contact features to spam, defraud, solicit improperly, harass, or endanger other people.
- Attempt to access, disrupt, attack, or interfere with the Service, its security, or its normal operation; scrape or harvest data or other users’ information by automated means; or misuse the QR-scan, autofill, or any other mechanism.
- Submit through any feature (including the business-listing autofill) information that you have no right to submit.
We may remove any content and suspend or restrict access at our discretion, including when content or conduct breaks these Terms or is harmful to other people or to the Service. We are not obliged to monitor all content or activity, and we do not guarantee that we will act on any particular report.
5. User Content
Some content on the Service comes from users. This includes business listings, feedback and contact messages, activity and event posts, comments in activity discussion threads, and links that users post (such as booking links, coordination or group-chat links, and contact details).
- This content is yours and your responsibility. You — not KalyKala — are responsible for anything you submit or post, and you confirm that you have the right to submit it and that it does not break these Terms or any law or third-party right.
- You keep ownership of the content you submit. You grant KalyKala a non-exclusive, worldwide, royalty-free licence to store, display, and use that content for the purpose of operating and providing the Service.
- We do not endorse or verify user content. Listings, posts, comments, and posted links are created and controlled by users. We do not certify that they are accurate, safe, or reliable.
- We may remove or hide user content at any time, including through moderation tools such as hiding comments, removing a person from an activity, and acting on reports sent to us — but doing so does not make KalyKala the author or the guarantor of any user content.
When you join an activity, the display name you choose is shown to other signed-in people who have joined the same activity, and to the activity’s coordinator. See the Privacy Policy for how this works.
6. Business Listings and Owner Responsibilities
If you claim, submit, or edit a business listing, you are responsible for the accuracy of that listing.
- Keep your listing accurate and current. Contact details, address, opening hours and seasons, menus, offerings, and other information you provide should be truthful and kept up to date. Information you do not update may become out of date.
- Diet and similar tags are honesty-bound.If you mark an item or a place with a dietary tag (for example, vegan), you must do so honestly — only when the item is marked that way on the menu or is plainly that way as served. Do not tag something as, for example, “vegan if modified.” Others rely on these tags.
- You are responsible for your own transactions. Any dealing between a business and a visitor — a booking, an order, a payment, a service — is between them. KalyKala is not a party to it.
We may edit, decline, or remove a listing, and we decide whether and when to publish one.
7. Activities and Events — Liability Allocation
The activities and events feature is a coordination surface only. It lets a host or coordinator list an activity and lets other people find it and join. It is important that you understand the following, because it defines what KalyKala does and does not do:
- KalyKala brokers nothing and holds no money. Any price, cost, payment, deposit, or booking connected to an activity, offering, or business is arranged strictly between the attendee and the host, coordinator, or business. KalyKala is not a party to any such arrangement, processes no payments, holds no funds, operates no checkout or escrow, and takes no commission. Where a listing offers a way to book or pay, it does so through an outbound link or the business’s own contact channel (such as its phone or WhatsApp); the transaction happens off KalyKala and is not handled by us.
- Coordination is between attendee and host. The coordinator organises the activity; people join it. Any group chat, coordination link, or one-to-one contact method shown on a listing is supplied by users and leads off KalyKala to third-party services. KalyKala provides the listing and the discussion thread and nothing more.
- We make no promises about any activity. We make no representation or warranty about any activity, host, coordinator, price, safety, quality, or outcome, and we do not vet or verify hosts or attendees. Deciding whether to join, meet, pay, or take part is your own decision, and attendance is at your own risk.
- Meetups happen offline, between people. KalyKala is not a party to, and is not responsible for, any meeting, activity, or interaction that people arrange through the Service.
8. Third-Party Links, Apps, and Services
The Service links to and relies on third-party websites, apps, and services — for example, ferry information, booking and coordination links posted by users, maps and directions, local organisations, and companion apps.
These links and services are provided for convenience. We do not control, endorse, or take responsibility for any third-party site, app, service, or content, and we are not affiliated with them unless we say so. Your use of any third-party service is at your own risk and is subject to that third party’s own terms and privacy policy.
Some of these links are affiliate or referral links, from which we may earn a commission if you book or buy through them (see section 2). This costs you nothing extra, does not change the price you are offered, and does not make us a party to, or responsible for, anything you arrange with that third party.
9. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the maximum extent permitted by law.
- Information may be inaccurate or out of date. Much of the content — business details, hours, menus, activities, ferry times, and links — is supplied by users or by third parties, and changes over time. We do not warrant that any information on the Service is accurate, complete, current, or reliable. Always confirm important details (such as opening times, prices, ferry schedules, and safety information) directly with the business or provider.
- We do not warrant that the Service will be uninterrupted, secure, or error-free.
- KalyKala is not an emergency, rescue, or safety service. In an emergency, contact your local emergency services (for example 112 in the EU and the UK, 911 in the United States).
9A. Outdoor Activities and Climbing — Assumption of Risk
Kalymnos is a climbing destination, and parts of the Service describe, link to, or support outdoor activities — climbing-related content and tips, links to a companion climbing-partner app, and companion tools such as Shadeline, which estimates sun and shade at climbing crags.
- Outdoor sports are inherently dangerous. Rock climbing, bouldering, hiking, swimming, and similar activities can result in serious injury, permanent disability, or death. If you take part in them, you do so entirely at your own risk, and you are responsible for your own preparation, equipment, competence, and decisions.
- Nothing on the Service is safety information. Content about crags, routes, shade, sun, weather, terrain, activities, or conditions — whether it comes from us, from users, or from a companion tool — is general information that may be wrong, incomplete, or out of date. It is not advice, and it is not an assurance that any place, route, time, or activity is safe. Always verify conditions yourself and use your own judgment.
- Shade and terrain estimates are approximations. Tools such as Shadeline compute estimates from imperfect data and models. Do not rely on them for safety-critical decisions — for example about heat, daylight, or descent times.
- KalyKala does not organise, supervise, or lead any climbing or outdoor activity. The limits in section 10 apply to any claim arising from one.
10. Limitation of Liability
To the maximum extent permitted by law:
- KalyKala, KalyKala LLC, and its members, officers, employees, contractors and agents will not be liable for any indirect, incidental, special, punitive, or consequential loss or damage, nor for any loss of profit, revenue, business, goodwill, data, or opportunity, however arising.
- In particular, we will not be liable for any loss arising from your reliance on information on the Service; your dealings or interactions with any business, host, coordinator, or other user; any activity, meeting, booking, or transaction arranged or found through the Service; any third-party site or service reached from the Service; or any unavailability of, or change to, the Service.
- Our total aggregate liability to you for all claims relating to the Service in any twelve-month period is limited to the greater of (a) the total amount you paid us for the Service in that period, or (b) EUR 100.
- These limits apply however the liability arises — in contract, tort (including negligence), or otherwise — and apply even if we have been advised of the possibility of the loss.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law — including liability for death or personal injury caused by our negligence, for fraud, or for any other liability that the law applying to you does not permit to be limited or excluded. Nothing in these Terms affects any mandatory rights you have as a consumer.
11. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains the limited personal data we hold, how it is used, and how to contact us with a data request.
For clarity about what the Service does measure: KalyKala uses no advertising or tracking cookies and no fingerprinting, and shows no consent banner. It does use a cookieless analytics service (Umami) for aggregate page and interaction counts, records one row per QR-code scan containing only which code was scanned and when, and — for signed-in functionality — allows our authentication provider (Clerk) to set essential first-party sign-in cookies. None of these identifies you to us, and none is used for advertising or profiling. The Privacy Policy describes each in full.
12. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will update the “Last updated” date at the top of this page. Your continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree with a change, please stop using the Service.
13. Governing Law
These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-laws rules. The state and federal courts located in New Mexico have jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you and we consent to that jurisdiction.
If you are a consumer resident in the European Union or the United Kingdom, this does not take anything away from you. You keep the protection of any mandatory consumer-protection rules of the country where you live, and you may bring proceedings in the courts of that country. Nothing in these Terms overrides those rights.
